Terms and Conditions for the Monnalisa Preloved Service
The website 2ndact.monnalisa.com is owned by the company Monnalisa s.p.a., based in Madame Curie 7, 52100, Arezzo, P.IVA 01163300518 and is managed by REM s.r.l. via Bonistallo 50/B, 50053 Empoli (FIp.i. 07022910488.
These general terms and conditions of sale (hereinafter, "General Conditions") govern all sales of used or new Monnalisa products with tags (hereinafter, "Products" or "Product") concluded remotely on the website 2ndact.monnalisa.com (hereinafter, the "Site").
The provision of data necessary for the execution of commercial transactions, as well as the Privacy Policy, is necessary to proceed with the purchase of the Products on sale.
Before each purchase, the Customer must carefully read the conditions below and keep a copy in paper or digital form.
Contracting Parties
The Manager is: REM s.r.l. with registered office in via Bonistallo 50/B, 50053 Empoli (FI) p.i. 07022910488
2NDACT by DRESSO is a White Label platform of second hand exclusive of the Brand developed by the Manager, for which it is customized, allowing to sell and buy, also through auction, products and garments of the Brand.
The company was entrusted from the Brand of the management of its secondary market through the platform 2NDACT by DRESSO.
The Operator is not in any way responsible for the purchase of products of the Brand present on other sites.
The buyer user is the user who buys the product following the submission of the purchase proposal.
The seller user is the user who sells the product following acceptance of the purchase proposal.
The Shop Site 2ndact.monnalisa.com is dedicated exclusively to consumers (hereinafter, "Customers" or "Clients"); 'consumers' means natural persons, over 18 years of age, who act for purposes unrelated to their business, entrepreneurial, craft or professional.
Product or Products - One or more of the products promoted and available for purchase/order on the Website 2ndact.monnalisa.com;
Order - the order of the Product or Products, made by the Customer on the Site.
Scope of application
By submitting an Order you declare that you have read, understood and accepted these General Conditions of Sale.
By placing an Order, the Customer declares:
1) to be a consumer according to art. 3 Dlgs 206/05;
2) be of age;
3) that the data provided by him for the execution of the Contract are correct and true;
4) have read all the information provided to him during the purchase process, and accept in full the general terms and conditions of payment indicated in the purchase process.
The Seller reserves the right to modify these General Conditions of Sale at any time by publishing a new version on this website. The conditions applicable to the individual Order are those published on the Site at the time of placing the Order.
Applicable law and jurisdiction
This contract is governed by Italian law. For any dispute that may arise in relation to the application, interpretation and execution of these general conditions, will be exclusively competent the Court of Florence - Italy, if this competence is not exceeded, in favor of the court of the place where the Customer has his residence or domicile - if located in the Italian territory, pursuant to d.lgs. 206/05.
ORDER PROCEDURE AND CONCLUSION OF THE CONTRACT
The Customer may choose the products available within the range proposed by 2ndact.monnalisa.com. The catalogue of products available on the site is composed of the products purchased by users of the site www.monnalisa.com who have accepted the request to receive commercial communications. Once the products have been identified:
- through the Make an offer button on the product tab, the customer leaves their personal data and email address, makes an offer for the used product and has the opportunity to leave a comment on the requested condition.
- the Operator will question all users who have purchased that product by sending the resale offer received from the buyer user,
- in the event that the user who had purchased the product is interested in selling, he must send photographic documentation proving the condition of the product and a possible counteroffer to the Operator,
- the documentation will be sent to the potential buyer, with a possible counterproposal, who will be free to accept and pay for the product through the checkout link.
- The buyer customer can also make a counter offer to the seller customer who will only have the option of accepting or rejecting the offer.
Data entry: At this stage, the buyer will be able to view the quantities, final prices, contact details and any other relevant information, and to enter the personal and credit card data necessary to complete the purchase,
- The buyer is obliged to send the complete order in all its parts. The order does not bind the Manager until the moment when the seller customer has shipped the product and the Manager has verified the originality of the product,
- The order confirmation will contain a summary of the products purchased, their prices, the expected delivery date and the general and particular conditions applicable to the order.
- In case of confirmation of the transaction 2NDACT by DRESSO will send the shipping label to the seller indicating the maximum period in which to carry out the shipment or agreeing on the day of collection of the package and manage the shipping procedure.
- The packaging of the product will be carried out by the User and not by 2NDACT by DRESSO or the carrier.
- In the event that the seller has chosen the option to receive payment by spending the sale amount with "store credit" in the official e-commerce of the Brand, the Brand will provide 2NDACT by DRESSO the credentials to allow the purchase of the respective amount
- The package will be picked up by the carrier at the address indicated by the seller and will be delivered to the warehouses of the brand or 2NDACT by DRESSO who will carry out the necessary checks to verify the authenticity and originality of the product, the correspondence to the article and size requested and sold in platform, the conditions of use that must conform to those declared in platform by the User seller.
- In this way the brand will be able to guarantee that through its platform is sold second-hand original and verified, minimizing possible cases of scams, disputes and missed shipments.
- In case the product has passed positively the step of the previous point, will again be taken over by the carrier for shipping to the buyer and 2NDACT by DRESSO will send a notice to the seller User in order to select the method of receiving payment.
Obviously, no amount will be charged for the products not available and in the event that such unavailability emerges after payment, the Seller will promptly pay the sums paid in excess of this title by the Customer.
The Owner reserves the right, at its discretion, to refuse the execution of certain orders, in particular (but not exhaustively) in case of past defaults and unpaid invoices. In case of non-acceptance of the Order, for any reason, the Manager guarantees the prompt communication to the Customer (in any case within 30 days of the Order) with the appropriate means.
The seller user will receive at the time of sale the entire amount paid by the buyer as a coupon to be spent on the site www.monnalisa.com or a cash out of 80% of the amount to be received by bank transfer.
- If the product has not passed the control carried out by the Brand:
1) if it is counterfeit and not original, the Customer will activate 2NDACT by DRESSO for the contestation procedure with which in the first place he will communicate to the User seller the behavior detected with the consequences that the Brand considers to assume (destruction of the property, complaint to the competent A.G. etc.).
2) if it is not in accordance with the requirements, or in case of a different product, size and model, the Customer will activate 2NDACT by DRESSO for the due communication to both Users (seller and buyer) within 24 hours and for the effective return procedure within 5 days. from the communication. In this case, the product will remain in the Customer’s warehouses for 30 days and the seller may retrieve it with its carrier at its own expense, giving notice to 2NDACT by DRESSO. After the 60 days from the original communication of 2NDACT by DRESSO (non-conformity of the product), without the User has withdrawn the product, the Customer may destroy it, since silence and failure to comply is valid as authorization for disposal of the product.
3) if it is not in accordance with the state of use declared by the Platform Seller User according to standards that will be defined in advance by the Brand, including them in the terms conditions present on the platform (e.g. equal to the new, in excellent condition, in good condition etc.), the Customer will activate 2NDACT by DRESSO in order to inform both Users and still allow to finalize the purchase with an acceptance by the User buyer, despite the non-conformity and correspondence to the declared state of second-hand. In this case, the buyer may request to apply a percentage of discount on the price initially proposed.
- Following the delivery of the product to the User seller, any evidence of damage to the packaging and/ or the product must be immediately disputed by the User seller, placing written reservation of control (specifying the reason for the reservation, e.g. "laundry packing", "crushed packing", etc.) on the courier’s proof of delivery. Once the courier’s document is signed, the User will not be able to object to any external characteristics of what has been delivered. In the event that the User buyer still believes that the Product is not compliant with what ordered and/ or purchased, or is defective, must immediately contact 2NDACT by DRESSO which in turn will notify the Customer following its company policy.
Products and availability
The Products that can be ordered are those displayed on the Site. Once the offer has been received, the Manager will ask the users who own the product for their willingness to sell.
The Operator also reserves the right to change, remove or add Products displayed on the Site at its sole discretion.
The Operator cannot be held responsible for temporary or permanent unavailability due to the seller’s unwillingness to sell. In the event that it is not possible to execute the Order due to unavailability of one or more Products, the Seller will inform the Customer in writing within 30 days.
Prices and charges of the buyer
The applicable prices for the Products ordered are those resulting from the negotiation with the seller user moderated by the Operator.
Payment of any customs duties, taxes, duties and border charges will be the sole responsibility of the buyer. If the calculation of customs duties, taxes, duties and border charges cannot be carried out at the time of purchase, the corresponding payment will in any case remain with the Customer. The Operator, therefore, cannot be held responsible for the non-delivery of the purchased Product, if it is due to the non-payment of customs duties, taxes, duties and border charges.
However, the shipping costs that will be indicated on the Site at the time of placing the Order and that will vary according to the place of shipment, the weight/ size of the package, as well as the size of the Order are not included.
Any promotions related to delivery costs will be highlighted on the Site from time to time.
In the case of deliveries outside the national territory, the Customer will be subject to compliance with the laws and regulations in force in the country of dispatch and possibly also to the payment of additional customs clearance costs entirely at its expense and of which, Given the diversity of national regulations, it is not always possible to know their extent beforehand.
For this purpose, the Customer must contact the competent customs office.
Payments
Payments can be made in several ways. At the moment of acceptance of the order proposal, the Buyer will pay the corresponding amount by credit card (among those indicated on the Site) or through other forms. Payment can be made using only one type of card that covers the entire amount of the purchase. The transaction data will be encrypted during the transactions for security reasons and in any case the payment methods ensure maximum safety on the purchase for the buyer.
The Operator reserves the right to request additional information from the Customer (e.g. a landline phone number) or copies of documents. In the absence of the required documentation, the Manager reserves the right not to accept the Order. No computer archive of the Operator will keep such data.
In no case can the Operator be held responsible for any fraudulent and improper use of credit cards or other means of payment by third parties, when paying for products purchased on the Site.
Unless otherwise agreed with the Customer, in case of cancellation of the Order, either by the Customer or in case of non-acceptance of the same by the Manager, the latter will be requested at the same time to cancel the transaction and release the amount.

Purchases made on the website 2ndact.monnalisa.com can be paid by credit card - Visa - Mastercard - American Express - Maestro.

Order Cancellation
It is possible to cancel an order before shipment by the seller user. If the communication of cancellation request for any reason should arrive after the seller customer has shipped the product, the order can no longer be canceled.
Returns and refunds
The return of products is not provided for used products. The refund is allowed only in three cases:
If the item does not correspond to what is stated in the order confirmation.
If the object has a hidden defect that affects its use
If the conditions of the object are significantly different from those reported at the time of the negotiation.
For the return of the object it is necessary to send an email to support.2ndact@monnalisa.com with the information of the order and with the supporting documentation one or more of the problems mentioned above.
Any dispute will be carefully evaluated by the Manager’s staff and in some cases the Manager may partially refund or not refund the Buyer user.
Conditions of returned products
We will not accept the return of those Products that are not in the same condition as they were received, or that have been used beyond the mere opening of the Product.
The non-diligent use of the good that has compromised its integrity, or the use of any consumables related to the product does not give the right to request the return of the product;
Lack of the original outer packaging and/or inner packing;
The absence of integral elements of the product (accessories, parts, etc.);
Damage to the product due to causes other than its transport, including partial or total tampering with the product or parts of it.
In the event of revocation of the right of withdrawal, the goods will remain at the headquarters of the Manager, available to the Customer Seller for collection at his expense.
Lack of conformity
At the time of delivery of the goods by the courier, in particular, the Customer is invited and in any case required to check:
The number of packages actually delivered corresponds to that indicated in the transport document;
That the packaging of the packages is intact in all its parts, not damaged or compromised by weather events or otherwise altered.
What to do in case of defects
Any evidence of damage to the packaging and/ or product or mismatch the number of packages or indications, must be immediately communicated by placing written check reservation (specifying the reason for the reservation, e.g. "soiled packaging", "crushed packaging", etc.) on the courier’s proof of delivery. Once the courier’s document is signed, the Customer will not be able to object about the external characteristics of what has been delivered.
If the Customer believes that the Product is not in accordance with what he ordered and/ or purchased, or is spoiled, must immediately contact the Manager by sending an email to support.2ndact@monnalisa.com.
The Customer must then return the Product in accordance with the procedures provided for in the Returns and refunds section.
